You can file for divorce without the aid of an attorney. This is called filing in Pro Persona, "ProPer", and means you are representing yourself rather than hiring an attorney to represent you. The Circuit Court Clerk’s Office on the 2nd Floor of the Courthouse sells "Divorce Packets" for $75.00. It will require some time on your part to read, fill out, file and serve the paperwork.
A Pro Per litigant who is acting on his or her own behalf, is under the law, held to the same standards and duties as an attorney admitted to the practice of law in the State of Michigan. Such person is expected to know what the law requires and how to accomplish his or her purposes in accordance with the applicable statutes and court rules. Judges and hearing officials cannot provide legal advice. Please note the staff of the Circuit Court Clerk’s Office cannot give you legal advice and they will not call or write you concerning the filing of any documents pertaining to your case. It is your responsibility to read the procedural instructions provided to you with the Divorce Packet prior to filling out any of the documents. If you need to purchase additional forms, they are available at $5.00 per form at the Circuit Court Clerk’s Office.
WAITING PERIOD & FEES
Divorce Without Minor Children: You have to wait a minimum of 60 days from the date of filing the Complaint to have your Divorce finalized. The filing fee at time of filing paperwork is $170.00
Divorce With Minor Children: You have to wait a minimum of 180 days from the date of filing the complaint to have your Divorce finalized. The filing fee at time of filing paperwork is $170.00.
These waiting periods are set forth by the State of Michigan, final hearing dates are scheduled according to Court calendar availability.
